Terms of Service for Humble Photo Contest

These Terms of Service (the "Terms") apply to the Humble Photo Contest (hereinafter referred to as the "Service"). By accessing or using the Service, or by registering an account, you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree to all of these Terms, do not use the Service.
2. Eligibility and Age Restriction
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
3. User Rights and Obligations
3.1. Account Management
You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree not to transfer your account to any third party. The Operator shall not be liable for any loss or damage arising from your failure to comply with this security obligation or from unauthorized use of your account.
3.2. User Content and Copyright
You retain all ownership rights and copyright to the photographs you upload to the Service ("Your Content").
To enable the functionality of the app, you grant the Operator a license to use Your Content within the app as necessary to operate the Service.
By uploading Your Content, you grant the Operator a non-exclusive, worldwide, royalty-free license to use, reproduce, and display Your Content for the purposes of operating the photo contest and for archiving contest results. Your copyright remains with you.
3.3. Group Host Responsibilities
A Group Host possesses all administrative rights and duties within a contest group. This includes the right and obligation to invite group members and manage group access through an access password.
4. Prohibited Activities
You agree not to upload, post, or transmit any content that:
- Infringes upon the copyright or portrait rights (publicity rights) of any third party.
- Is illegal, harmful, or offensive, including, but not limited to, content that is violent, sexually explicit, hateful content, or otherwise deemed offensive or inappropriate by the Operator or the group host in their sole discretion.
5. Limitation of Liability
5.1. General Disclaimer
The Service is provided on an "as-is" basis. The Operator shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use of or inability to use the Service, except in cases of the Operator's willful misconduct or gross negligence.
5.2. Third-Party Disputes
The Operator is not responsible for any copyright or portrait right disputes that may arise between users and third parties. You are solely responsible for ensuring that Your Content does not violate the rights of others.
5.3. Force Majeure
The Operator shall not be held liable for any failure or delay in performance of the Service resulting from causes beyond its reasonable control, including but not limited to natural disasters, war, hostilities, hacking, or natural disasters.
6. Service Suspension and Modification
The Operator reserves the right to modify, suspend, or terminate the Service temporarily or permanently, with or without prior notice, at any time.
7. Amendments to the Terms
The Operator may modify these Terms at any time. We will notify you of any changes through a notice posted on this page or via email. If you do not object within seven (7) days of such notification, you will be deemed to have agreed to the modified Terms. If you object to the modified Terms, you must immediately cease using the Service and terminate your account as outlined in Section 9.
8. Privacy
The collection and use of your personal information are governed by a separate Privacy Policy.
9. Termination and Withdrawal
You may terminate your account and withdraw from the Service by contacting the developer via email at [email protected].
